Problem: Axel Arigato had a part of its production in Turkey. Suddenly we discovered an identical trademark application made by a Turkish actor. Objection could be done after our client made an expansion of its trademark rights through WIPO and prevent the other party from having the application registered. If the Turkish actor had got the trademark registered, our client could have had major issues with shipping out the shoes from Turkey and expensive costs.
Solution: If you look at the application of the Turkish company, you might be able to use the fact that they applied for the trademark maliciously. The best way is to be proactive and avoid these situations in the first place by either register the trademark where you have your production or at least have a watching service that will give you a heads-up if someone is trying to register the same Trademark name. Otmore can offer Trademark Watching services in all jurisdictions.
