New upcoming rules regarding Community Trademarks (CTM)

A press release from The EU Commission, EU Parliament and Council of Ministers announces that they have agreed on the content of the new European Trademark Law. As it is a provisionally agreement, there is no detailed documents published yet.

The statements in the press release are general in content but the statement mentions a few things such as, a cheaper and more accessible system within the European Trademark Law.

Two concrete details are mentioned according to brandnews.se:

  • The authority for Community Trademarks in OHIM, Alicante (The Officefor Harmonization in the Internal Market) will change their name to EUIPO (European Union Intellectual Property Office).
  • In an application for a Community Trademark, up to three product- or service classes have previously been included in the initial filing. In the new system, there will only be one class included. This change will most certainly lower the initial fee for a trademark application.

An interesting fact, noted by Otmore, is that OHIM has not yet filed an application for their new name EUIPO.
